1. Changes to This Policy

We reserve the right to revise this Policy from time to time, for example, to keep up with changes in the law, or to reflect changes in how we are doing business. When we make changes, we will update the “Effective Date” at the top of this Policy. In the event that this Policy is modified in any way, we will use commercially reasonable efforts to notify users of any material changes. We suggest you review this Policy periodically to ensure you are aware of our current privacy practices. We update our Policy as needed to reflect our practices and legal requirements.

2. Information We Collect

We collect certain personal information about you and your use of our App. The definition of personal information (used interchangeably with “personal data”) depends on the applicable law based on your physical location or state residency. Only the definition that applies to your physical location or state residency will apply to you under this Privacy Policy. The personal information that we collect generally falls into three primary categories: (1) information you voluntarily provide to us; (2) information we collect from you automatically; and (3) information we collect from third parties.

Information You Voluntarily Provide to Us. We, or our service providers that assist us in providing, maintaining, and operating our App, may collect the following types of personal information from you:

  • Account and Identification Information: Email address, username, first and last name, and password.
  • User-Generated Content: Audio, video, images, and other content uploaded by artists. Text-based comments and replies posted by fans.
  • Payment and Transaction Identifiers: Stripe customer ID and RevenueCat customer ID.
  • Customer Support: records and copies of your correspondence (including email addresses), or additional information you choose to share with us.

Information We Collect from You Automatically. To the extent permitted under applicable law, we may automatically collect certain types of personal information about you when you use or interact with our App:

  • Usage Data. When you browse our App, we automatically collect log data such as your app activity, Internet Protocol (“IP”) address, domain names, screens or features accessed, the date and time you access our servers, and other diagnostic data.
  • Device Information. We may be able to identify your device’s unique device identifier, MAC address, operating system, and your mobile device identifier.

Information We Collect from Third Parties. We may obtain information about you from third party sources as required or permitted by law. These sources may include:

  • Social Media. We may offer you the opportunity to engage with our content on or through third-party social networking websites, plug-ins and applications. When you engage with our content on or through third-party social networking websites, plug-ins and applications, you may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture, gender) to deliver the content or as part of the operation of the third-party website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on our App and on the third-party social networking websites, plug-ins and applications, and to provide you with other products or services you may request.
  • Third Party Partners.  Unless prohibited by applicable law, we may obtain your personal information from analytics providers to provide us information necessary to improve our App. Analytics and crash reporting data is collected in an aggregated and anonymized manner and is not used to identify individual users. The App does not use third-party SDKs for advertising or behavioral ad-targeting.
  • Single Sign-on (“SSO”). SSO is an authentication method that enables you to securely authenticate your login within multiple applications and websites by using one set of credentials.  If you choose to login to our Services through a third-party platform (such as Facebook or Google) we may have access to certain information from that platform, such as your username or email address. The information we receive may vary based on your privacy settings on such platform or as otherwise controlled by the provider of such platform.

We do not collect sensitive personal information such as precise geolocation, biometric identifiers, government-issued identification numbers, or information relating to race, religion, or health. Identity verification for artist payouts is handled directly by Stripe.

3. How We Use Personal Information

We may process your personal information in connection with any of the following:

  • To Operate and Administer Our Services. We may use your personal information to provide you with the services that you request, such as creating and managing your user accounts, and enabling user interactions with artists and content, including transactions for the purchase of virtual currency and processing payouts to artists.
  • To Provide Customer Support or Respond to You. We collect any information that you provide to us when you contact us to respond to your inquiries and to fulfill your requests. Without your personal information, we cannot respond to you or ensure your continued use and satisfaction of the App.
  • To Provide You with Service-Related Communications. We may send you administrative and account-related information to you, for example, privacy policy and terms updates, security updates, confirmations of your account actions or transactions, or other relevant transaction-related information. Service-related communications are not promotional in nature. You may not be able to unsubscribe from certain service-related communications, otherwise you may miss important developments relating to your account or the App.
  • To Provide Marketing Communications (e.g., SMS, Email). Subject to your marketing preferences, we may send you newsletters or marketing communications we believe may interest you, for our own products and services. When you no longer wish to receive these marketing messages from us, you can opt out at any time by unsubscribing or following the instructions contained within such messages.
  • For Research and To Develop Our Services. We may process your personal information and derive analytical and statistical data to better understand the way you use and interact with our App, including by carrying out data analysis, audits, fraud monitoring and prevention, internal quality assurance, developing new products, enhancing, improving or modifying our App, identifying usage trends, auditing use and functionality of our App, and operating and expanding our business activities.
  • To Facilitate Corporate Acquisitions, Mergers and Transactions. We may process any information regarding your account and your use of our App as is necessary in the context of corporate acquisitions, mergers, or other corporate transactions.
  • To Ensure the Security of the Services. We may process your personal information to combat spam, malware, malicious activities, or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information.
  • To Maintain Legal and Regulatory Compliance. Our App may be subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to pay our taxes, to fulfill our business obligations, or as necessary to manage risk as required under applicable law, or to respond to requests by judicial process or governmental agencies.

4. How We Share Personal Information

We may disclose your personal information as follows, as permitted under applicable law:

  • Our Corporate Group. We may disclose some or all of your personal information with our subsidiaries and corporate affiliates, joint ventures, or other companies under common control with us for the purposes described in this Privacy Policy unless otherwise prohibited by applicable law or by contractual agreement with our vendors, service providers or other third parties.
  • Vendors and Service Providers. We may disclose personal information to vendors, service providers, contractors, professional advisors, and other entities that need this information to provide services to us, such as: assisting us in e-commerce operations; managing a database of customer information; hosting the App; designing and/or operating the App’s features; tracking the App’s activities and analytics; enabling us to perform other administrative services; and other services designed to assist us in maximizing our business potential. These service providers may have access to or process your personal information only for the purpose of providing services to us.
  • Artists and Rights Holders. When you purchase content, products, or services from an artist, content creator, or other rights holder on the App, or subscribe to their content, we may share your contact information (such as your email address) with that artist or rights holder so they can fulfill your order and communicate with you about your purchase or subscription. In addition, with your consent, we may share your contact information with artists or rights holders with whom you engage on the App so that they can communicate with you directly, including about their content, products, and offerings. We may also share personal information with artists, content creators, or other rights holders as necessary or beneficial to facilitate or otherwise learn from user behavior, interactions with users, content distribution, and transactions on the App, including where users engage with, support, or transact with such artists or content.
  • Analytics Partners. We use third-party analytics providers to collect information about your use of the App, see the overall patterns of usage on the App, and optimize performance. We do not sell or share your personal information to third parties for advertising purposes.
  • As Necessary to Comply with Our Legal Obligations. We may disclose your personal information to law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Indigo (including through the enforcement of this Privacy Policy, our Terms and Conditions, and other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas, or court orders).
  • As Part of a Corporate Transaction. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the App; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all our interests and/or assets, or other corporate change, including during the course of any due diligence process.

5. Storage of Payment Information

Indigo uses a virtual currency called “indicoins.” Fans may purchase indicoins to tip or support artists or to access exclusive content. Although indicoins operate as in-app credits, they carry monetary value and may be redeemed by artists for real money.

We use RevenueCat to manage and track indicoin purchases. RevenueCat supports purchase logic and entitlements, including indicoin pack purchases made through in-app purchases (IAP) on iOS or via web checkout. It ensures compliance with platform requirements, such as Apple’s mandate to use IAP for in-app transactions and maintains records of user purchase history and indicoin balances. RevenueCat does not process payments, store sensitive financial information, or handle payouts.

Stripe is our designated payment processor and manages all real-money transactions. Stripe securely processes payments when users purchase indicoins (including via Stripe Checkout on web), holds platform funds, manages balances, and issues payouts to artists when indicoins are redeemed for cash.

Indigo does not directly store sensitive payment information such as full credit card numbers or bank account details. All payment data is processed exclusively by third-party providers such as Stripe, which comply with strict industry standards (including PCI DSS). Indigo retains only the limited records required for payment verification, dispute resolution, fraud prevention, and compliance with applicable law.

6. Tracking Technologies

The App uses third-party SDKs for analytics, crash reporting, and operational monitoring. These tools are used solely to support App functionality, stability, and performance. We do not use third-party SDKs for advertising or cross-context behavioral advertising. Analytics data is collected in an aggregated and anonymized manner.

7. Social Media Pages

We may maintain pages on social media platforms and support sharing content to third-party social media networks through our App. Any information you post or provide through such pages is subject to the privacy policies of those platforms, and you should review them carefully. We are not responsible for the collection, use, or disclosure practices (including data security) of any social media platform or other third party, including any personal information you disclose to other organizations through or in connection with our social media pages.

8. Security

We use commercially reasonable administrative, technical, and physical safeguards to help protect and secure your personal information from unauthorized access, modification, disclosure, or destruction. These measures include encryption of data in transit using TLS 1.2 or higher, encryption of data at rest using AWS-managed services, and strict controls over access to data. While we take all reasonable precautions to protect your information, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security. We are not responsible for the security of information that you transmit to the App over networks we do not control, including the Internet and wireless networks. Protecting your personal information is also your responsibility, and we urge you to take appropriate precautions.

9. Retention

We retain your personal information only as long as necessary to fulfill the purposes described in this Privacy Policy. User accounts and associated data are deleted immediately upon your request or upon account deletion, unless a legal obligation arises. We may retain certain limited records, such as payment history and financial transaction logs, as required by applicable law and regulatory obligations.

10. Children and Minors’ Privacy

The App is not intended for users under the age of thirteen (13). We do not knowingly collect personal information from children under thirteen (13). Users under the age of thirteen (13) are strictly prohibited from creating an account or otherwise submitting personal information to us. If you are a minor between the ages of thirteen (13) and seventeen (17), you may only use the App under the supervision of a parent or legal guardian, and with their consent. By using the App, you affirm that you are either over the age of eighteen (18), or that you are between thirteen (13) and seventeen (17) and have obtained parental consent to use the App. Parents and guardians are responsible for monitoring their child’s use of the App and ensuring that they use it safely and in accordance with this Privacy Policy. Indigo does not currently verify parental consent and relies on user representations regarding age.

If we learn that we have inadvertently collected personal information from a child under thirteen (13), we will take immediate steps to delete such information from our records. Parents or guardians who believe that their child may have provided personal data to us, or minor without parental consent, should contact us at the addresses listed in the “Contact Us” section below. We will promptly respond to verify and, where appropriate, delete the information.

11. Your Choices

Our marketing emails provide the ability for you to “opt out.” If you choose to opt out, we may still send you non-marketing emails, such as emails about your accounts and our business dealings with you.

Users may delete their accounts at any time through the App’s settings. You may also send requests about personal information by email or postal mail to the address listed in the “Contact Us” section below. Such requests can include requests to update your personal information, change contact choices, and opt out of our sharing of information with third parties, where permitted by law.

Requests will be handled in accordance with applicable data protection laws.

12. Privacy Rights

Where allowed under local law, you may have the right to submit a request for access to the data we hold about you. Further, we will correct inaccurate or out-of-date information about you at your request or when we become aware of the error. You can request that your data be made available for you to download or other export as well. Finally, you may request that we delete certain data we hold about you. However, your data will not be deleted in the following situations:

  • If you have any open or ongoing matter with Indigo’s customer service or technical support personnel; or

13. AI Features

Some features of Indigo are currently in testing and may include AI-powered functionality, such as artist chatbots or content recommendations. These features may involve processing user inputs through third-party AI providers. When AI features are released, we will update this Privacy Policy with details about how the data is processed and protected.
